1 INTRODUCTION

1.1: We may revise these terms and conditions at any time. You (being our customer, "you" or "your") should check this website when ordering to review the then current terms and conditions, because they are binding on you.

1.2: Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this website.

1.3 This document (together with any documents referred to in it) tells you the terms and conditions (the ‘Conditions’) upon which we will sell the Goods to you. You may print a copy for future reference.

1.4 Business Day: a day other than a Saturday, Sunday or public holiday when banks in London are open for business.

1.5 ‘Goods’ means the goods listed on our website, www.biodegradable-confetti.co.uk, which we may supply.

1.6 Before confirming your order please read through these Conditions and in particular our cancellations and returns policy.

1.7 By ordering any of the Goods, you agree to be legally bound by these Conditions. You will be unable to proceed with your transaction if you do not accept these terms and conditions.

3 ORDERING AND DELIVERING

3.1 You can place orders via our website – www.biodegradable-confetti.co.uk.

3.2 When ordering online you are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. This is your offer to buy the products. We will send you an email order acknowledgement, detailing the product(s) you have ordered, which is our acceptance of your offer.

3.3 Our acceptance of an order takes place immediately, we will send you a confirmation by email. When we despatch the order, the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

3.4 We may refuse to accept an order:

where goods are not available;

where we cannot obtain authorisation for your payment;

if there has been a pricing or product description error; or

if you do not meet any eligibility criteria set out in our terms and conditions.

3.5 Any dates quoted for delivery are approximate only, and the time of delivery is not of the essence. We shall not be liable for any delay in delivery of the products that is caused by an event outside of our control or your failure to provide us with adequate delivery instructions or any other instructions that are relevant to the delivery of the products.

3.6 If you have not received the products you must notify us no later than 28 days after the last date on which the products were due to arrive at the delivery address provided. If you have not done so, we shall not be liable for any replacement or refund relating to those products.

3.7 The Goods will be delivered to you at the address you provided during the order process which may be an address other than the billing address.

3.8 If you have agreed to collect the Goods from our premises, you must collect the Goods during our working hours of 10am to 4pm, Monday to Friday. Excluding Bank and public holidays.

3.9 You must examine the Goods within a reasonable time after arrival and let us know as soon as reasonably possible if they are faulty, damaged or not as described.

3.10 If no one is present at your delivery address to take delivery, Royal Mail will advise you of an attempted delivery. You must then contact them to make arrangements for them to re-deliver the Goods.

3.11 we cannot guarantee delivery before a specific date under any circumstances on the standard delivery. If your wedding is less than 7 days away you will only receive your order in time via Priority Delivery.


RETURNS

  1. Personalise products are ineligible for returns UNLESS found to contain error(s) which are not the fault of The Customer
  2. Customers have up to 30 days to return any qualifying unused goods
  3. Customers are responsible for the postal costs of returning unwanted goods to us

INTERNATIONAL DELIVERY


3.12 Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

3.13 If we agree to supply any goods ordered from the Website for delivery outside the United Kingdom, they may be subject to import duties and/or additional taxes or expenses incurred due to complying with foreign regulatory requirements or laws. You will be responsible for payment of any such duties and/or taxes in addition to our price including the cost of delivery. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office or taxation authority for further information before placing your order.

4 ELIGIBILITY TO BUY FROM OUR WEBSITE

4.1 To be eligible to purchase the Goods and lawfully enter into and form a contract with us, you must be 18

years of age or over.


5 PRICE

5.1 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

5.2 We do provide free carriage on all UK orders over £80.

5.3 Please note our currency converter is only a guide and may not accurately reflect current exchange rates You are responsible for the disclosure and payment of any import duties or other taxes, which may apply when the products are delivered. Unfortunately, we cannot advise you what these costs may be - please consult your local customs office for more information.

5.4 We always try to make sure that the prices on biodegradable-confetti.co.uk are correct but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming the order at the correct price or cancelling it. If the order is cancelled we will refund you in full.

5.5 In the event that you are purchasing from outside of the UK, please be aware that we will not remove the VAT element of the price, and any recovery of such sum should be made directly to HMRC or such other tax authority as appropriate.


6 PAYMENT

6.1 Payment can be made by any major prepay, credit or debit card or by using a PayPal account.

6.2 By placing an order, you consent to payment being charged to your prepay/debit/credit card account or PayPal account as provided on the order form.

6.3 If you pay us by credit or debit card or PayPal account we will take payment from your card or PayPal account as soon as the order has processed.

6.4 We shall contact you should any problems occur with the authorisation of your card or payment through your PayPal account.


7 CANCELLATIONS

7.1 Cancelling your Contract and returns

7.1.1 You may cancel your order for non-personalised Goods before they are despatched to you by notifying us of your decision. 

7.1.2 You may cancel your order for personalised Goods before production begins by notifying us of your decision.

7.2 You may notify us of your decision to cancel by contacting us by telephone: 01226891234 or by sending us an email to: infoconfetticones@yahoo.com.

7.3 You can return goods you have ordered from us for any reason at any time within 28 days of receipt for a full refund or exchange by informing us via our dedicated online returns section or by informing us via phone on 01226891234. The costs of returning goods to us shall be paid by you, and should be sent by recorded delivery as we will not provide the refund if the product is lost in the post.

7.4 Upon receipt of the goods we will give you a full refund of the amount paid, less postage and packaging, within 10 days.

7.5 We reserve the right to deny a full refund in the following circumstances: -

in the event that the product is not still within its original packaging and fit for resale;

•      the product has been damaged through any fault of your own;

the product is one which we have made or customised specifically for you

7.6 All items that are returned for an exchange will be resent to you via our standard delivery service free of charge. If a quicker service is needed then an additional payment for delivery will be required.

7.7 Stock Shortages/delayed orders. All delayed orders are subject to stock availability. If stock is unavailable and your order cannot be fulfilled, we will notify you with the option to claim a refund or a substitution to the same value or to wait for the item to become available.

7.8 Product imagery is offered as good representation of the product. However, we cannot be responsible for the colour accurateness of products viewed online or on printed media. While we endeavour to make sure all imagery is up to date, images may differ slightly from products due to the natural nature of certain products.

7.9  Upon receiving notice of your cancellation, we will contact you and provide details of where you must return the Goods and other relevant instructions. You must then return the Goods to us without delay and at the latest within 14 days of notifying us of your cancellation.

8.1 You are permitted to print and download extracts from this website for your own use on the following basis:

no documents or related graphics on this website are modified in any way;

no graphics on this website are used separately from accompanying text;

any of our copyright and trade mark notices and this permission notice appear in all copies; and

12 LIABILITY AND INDEMNITY

12.1 We have a duty to supply Goods to you that conform to the Contract including a duty to ensure

12.1.3 The Goods are fit for any purpose you specifically told us they were required for, and are not faulty

12.1.4 We reserve the right to customise the design, fonts and layout of your order at our discretion for any reason. Any returned personalised products will be refunded minus the cost of the personalised printing at our standard product rate. This does not include products not fit for purpose.

12.2 We cannot exclude our liability for a failure to comply with these duties mentioned in this sub- clause. Nothing in these Conditions affects your legal rights if these duties are not complied with. You can obtain advice about your legal rights from Citizens Advice if you need to.

12.3 We cannot exclude or limit our responsibility to you for:

12.3.1 Death or personal injury resulting from our negligence or the negligence of our employees

12.3.2 Fraud or fraudulent misrepresentation

12.4 We are responsible for foreseeable loss or damage which you suffer as a result of a breach by us of the Contract or as a result of our failure to act with reasonable care and skill. We are not responsible for unforeseeable losses.

12.5 You are purchasing the Goods as a consumer. If you purchase the Goods for any business purpose including for re-sale, we will not be liable for any business losses, loss of profits, loss of contracts, loss of business opportunities, loss of management time, loss of business data or losses due to interruption of your business.

12.6 We will not be responsible for any delay in delivering the Goods if

12.6.2 You have failed to provide complete and accurate information.
